Water shutoff halted for now

BELLE FOURCHE — Fourth Circuit Court Judge Michael Day issued a temporary restraining order in the civil case between Black Hills Water Distribution, LLC, and Hay Creek Water Company, LLC, this afternoon to halt water shutoff to 130 homes and Wyatt’s Hideaway Campground south of Belle Fourche.

Hay Creek Water Company filed the temporary restraining order today against Black Hills Water Distribution. Black Hills Water planned on turning off water for the area residents for what it claims is approximately $30,000 owed by Hay Creek Water.

For now, the issue is at a standstill until Oct. 15 when the matter will again be heard by the court.  

The civil case, ongoing since May, is an effort to resolve the differences between the two water companies who each allege the other to be in breach of contract.
